Please read these terms carefully before using the MketX platform.

By accessing or using the MketX platform, including our website, mobile applications, and related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and MketX (Private) Limited ("MketX", "we", "us", or "our"), a company registered and operating in the Republic of Zimbabwe.
MketX operates an online food delivery platform that connects customers ("Customers") with restaurants and food vendors ("Merchants") through independent delivery drivers ("Drivers"). MketX acts as an intermediary and does not itself prepare, cook, or deliver food.
The Platform enables Customers to browse menus, place orders, make payments, and track deliveries in real time. Merchants use the Platform to receive and manage orders, and Drivers use it to accept and fulfil delivery requests.
To use certain features of the Platform, you must create an account. You agree to:
You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
When you place an order through the Platform, you are making an offer to purchase food from the selected Merchant. The order is confirmed once the Merchant accepts it. MketX reserves the right to refuse or cancel orders at any time for reasons including but not limited to product availability, pricing errors, or suspected fraudulent activity.
All prices displayed on the Platform are in United States Dollars (USD) or Zimbabwean Gold (ZiG) as indicated. Prices are set by Merchants and may vary from in-restaurant prices. A delivery fee is calculated based on distance and is displayed before order confirmation. MketX may charge a service fee which will be clearly disclosed at checkout.
The Platform accepts the following payment methods:
All payments are processed through secure, PCI-compliant third-party payment processors. MketX does not store your full card details on its servers.
An electronic receipt will be generated for each completed transaction and made available through the Platform and via email.
Estimated delivery times are provided as guidance only and are not guaranteed. Delivery times may be affected by factors including traffic conditions, weather, order volume, and restaurant preparation times.
Delivery is available within designated delivery zones. You are responsible for providing accurate delivery address information. If delivery cannot be completed due to incorrect address details, inaccessible location, or absence at the delivery address, you may forfeit the order and payment.
Risk of loss and title for food items passes to you upon delivery. You should inspect your order upon receipt and report any issues immediately through the Platform.
You may cancel an order free of charge before the Merchant begins preparing it. Once preparation has started, cancellation may result in a charge of up to the full order value. Cancellation after a Driver has collected the order will result in the full order value being charged.
Orders may be cancelled by the Merchant if items are unavailable or the restaurant is unable to fulfil the order. In such cases, a full refund will be issued. MketX may cancel orders where fraud or a violation of these Terms is suspected.
Refunds are processed to the original payment method within 5-7 business days. For EcoCash payments, refunds are typically processed within 24 hours. If you receive incorrect or unsatisfactory items, please contact our support team within 2 hours of delivery to request a resolution.
Drivers are independent contractors and not employees of MketX. MketX does not control the manner or method by which Drivers perform deliveries, only the desired result of the service.
Drivers must maintain a valid Zimbabwean driver's licence, vehicle registration, and insurance as required by the laws of Zimbabwe. Vehicles must be in roadworthy condition and suitable for food delivery. Drivers using motorbikes must wear an approved safety helmet at all times.
Drivers are responsible for maintaining adequate motor vehicle insurance covering third-party liability. MketX does not provide motor vehicle insurance for Drivers. Drivers must ensure their insurance policy covers commercial delivery activities.
Drivers must maintain professional conduct at all times, handle food with care, comply with all traffic laws, and not consume alcohol or controlled substances while performing deliveries.
Merchants agree to pay MketX a commission on each order fulfilled through the Platform, as specified in their individual Merchant agreement. Commission rates are subject to periodic review.
Merchants are expected to accept and fulfil orders promptly. Repeated failure to accept or fulfil orders may result in reduced visibility on the Platform or termination of the Merchant agreement.
Merchants are solely responsible for the quality, safety, and hygiene of the food they prepare. Merchants must comply with all applicable food safety regulations under Zimbabwean law, including the Food and Food Standards Act [Chapter 15:04] and any local council health regulations. Merchants must hold all necessary licences and permits for food preparation and sale.
When using the Platform, you must not:

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Zimbabwe Data Protection Act, 2021 (Act No. 5 of 2021).
These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe.
In the event of a dispute, you agree to first contact MketX at [email protected] to attempt to resolve the matter informally within 30 days.
If the dispute cannot be resolved informally, the parties agree to submit to mediation under the Commercial Arbitration Centre of Zimbabwe. If mediation fails, the dispute shall be referred to binding arbitration in Bulawayo, Zimbabwe, in accordance with the Arbitration Act [Chapter 7:15].
Subject to the arbitration provisions above, the courts of Zimbabwe shall have exclusive jurisdiction over any legal proceedings arising from or relating to these Terms.
MketX reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 14 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
If you do not agree with modified Terms, you must discontinue use of the Platform and close your account.
These Terms, together with the Privacy Policy and any Merchant or Driver agreements, constitute the entire agreement between you and MketX regarding the Platform.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Failure by MketX to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights under these Terms without MketX's prior written consent. MketX may assign its rights and obligations without restriction.
